1. Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you ("you", "your") and ImgConvert ("we", "us", or "our") regarding your access to and use of the ImgConvert website and associated services (the "Service"). By using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of the service

The Service provides free, browser-based tools that allow you to convert image files between common formats and to compress image files to reduce their size. The Service is provided on an "as available" basis and may be modified, suspended, or discontinued at any time without notice.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

4. Your content and intellectual property

You retain all rights, title, and interest in the images and other files you upload to the Service ("Your Content"). We claim no ownership over Your Content.

By uploading Your Content, you grant us the temporary, non-exclusive, worldwide right to process it solely for the purpose of providing the Service — that is, to convert or compress the file and return the result to you. This limited licence ends automatically when the file is deleted at the end of the request.

You are solely responsible for Your Content. You represent and warrant that you own it, or otherwise have all necessary rights and permissions to upload and process it through the Service.

5. Acceptable use

You agree that you will not, and will not attempt to:

• Use the Service to upload, process, or distribute content that is unlawful, infringing, defamatory, obscene, sexually exploitative, or otherwise harmful.
• Upload content that violates the intellectual property, privacy, or other rights of any third party.
• Use the Service to transmit malware, viruses, or any code designed to disrupt, damage, or interfere with any system.
• Use automated means (scripts, scrapers, bots) to access the Service at a scale that would interfere with normal operation or overload our infrastructure.
• Attempt to reverse-engineer, probe, or circumvent any security measure of the Service.
• Resell, sublicense, or repackage the Service as your own.
• Use the Service in violation of any applicable law, regulation, or these Terms.

We reserve the right to rate-limit, block, or ban users or IP addresses that violate these rules or abuse the Service.

6. Service availability & changes

We strive to keep the Service available and working reliably, but we do not guarantee uninterrupted, error-free, or secure access. The Service may be unavailable during maintenance, updates, or unforeseen outages.

We may, at our discretion, add, remove, or modify features at any time. Features that are free today may be changed, restricted, or removed in the future.

7. No warranty

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will meet your requirements, produce specific results, be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. You use the Service at your own risk.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IMGCONVERT, ITS OPERATORS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Because the Service is provided free of charge, our aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed one hundred U.S. dollars (USD $100) or the equivalent in your local currency, whichever is less.

9. Indemnification

You agree to indemnify, defend, and hold harmless ImgConvert and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party.

10. Third-party links and services

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party site. You acknowledge that we shall not be liable for any damage or loss caused by or in connection with the use of any such third-party content or service.

11. Termination

We may suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users of the Service or third parties. Upon termination, your right to use the Service ceases immediately. Sections 4, 7, 8, 9, 10, 12, and 13 survive any termination of these Terms.

12. Governing law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which ImgConvert is operated, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the courts located in that jurisdiction, and you consent to their personal jurisdiction and venue.

13. Changes to these terms

We may revise these Terms at any time. The revised Terms will be effective when posted on this page, and we will update the "Last updated" date above. For material changes, we will provide prominent notice. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
